Winger – Terms of Service

1. Introduction

These Terms govern your access to and use of Winger's website, services, listings, and content. Winger acts solely as an online marketplace and is not an aircraft operator, aircraft owner, rental provider, or aviation service provider.

2. Definitions

• "Winger" / "we" / "us" / "our" refers to the Winger platform and its operators.
• "User" / "you" refers to any individual accessing or using the Platform.
• "Pilot" refers to a User seeking to rent an aircraft.
• "Lister" refers to an aircraft owner, operator, or flight school posting aircraft rental listings.
• "Aircraft" refers to any general aviation airplane listed on Winger.
• "Booking" refers to a rental agreement formed directly between Pilot and Lister.

3. Role of Winger

Winger provides an online space for Pilots and Listers to connect. Winger does not:

• Own, manage, maintain, or operate any aircraft.
• Vet or verify Pilot qualifications or Lister credentials.
• Guarantee the condition, safety, airworthiness, or legal compliance of any aircraft.
• Participate in any rental agreements or payment transactions beyond providing a connection platform.

All agreements, payments, safety checks, and regulatory compliance are strictly the responsibility of Pilots and Listers.

4. User Eligibility

To use Winger, you must:

• Be at least 18 years old.
• Have the legal capacity to enter binding agreements.
• For Pilots: hold all licenses, ratings, endorsements, medical certificates, and insurance required by applicable aviation authorities and the Lister.

Winger may suspend or terminate accounts that violate these Terms.

5. Accounts

Users must create an account to access certain features. You agree to:

• Provide accurate and up‑to‑date information.
• Maintain the confidentiality of your login credentials.
• Be responsible for all activity under your account.

Winger may remove or restrict accounts suspected of misuse.

6. Listings (for Listers)

By posting an aircraft listing, you confirm:

• You legally own or are authorized to rent out the aircraft.
• The aircraft is airworthy, maintained, and compliant with all regulations.
• You will provide accurate information on pricing, availability, and requirements.
• You will manage rental payments, check-outs, insurance verification, and pilot qualification validation independently of Winger.

Winger is not responsible for inaccurate or misleading listings.

7. Pilot Responsibilities

Pilots agree that they:

• Hold all required valid licenses, ratings, endorsements, and medical certificates.
• Meet the Lister's experience, currency, and insurance requirements.
• Conduct all necessary preflight checks.
• Fly in accordance with local aviation laws, regulations, and safety practices.
• Assume all responsibility for operating the aircraft during the rental period.

8. Bookings and Payments

All bookings are agreements made directly between the Pilot and the Lister. Winger is not a contractual party to these agreements.

Winger may facilitate communication between Users but does not:

• Manage payments.
• Handle deposits or refunds.
• Set pricing or rental conditions.
• Resolve disputes regarding bookings.

9. Insurance

Winger does not provide insurance for Pilots or Listers. Users are solely responsible for ensuring adequate insurance coverage.

Pilots and Listers must confirm insurance terms, coverage limits, deductibles, and liability responsibilities directly with each other.

10. Safety and Compliance

Winger does not verify or guarantee:

• Airworthiness of aircraft.
• Qualifications of Pilots.
• Maintenance records, logbooks, or regulatory compliance.

All Users acknowledge that aviation involves inherent risks and agree to assume these risks voluntarily.

11. Fees

Winger may charge service or platform fees to Users for access to certain features. Any applicable fees will be disclosed before use and may be updated from time to time.

12. Prohibited Conduct

Users agree not to:

• Misrepresent identity, qualifications, or aircraft information.
• Use the Platform for unlawful or unsafe purposes.
• Circumvent Winger fees or attempt unauthorized access to the Platform.
• Post harmful, fraudulent, or offensive content.

13. Communication

Users may communicate through the Platform. You agree that:

• Communications must be professional and lawful.
• Winger may monitor communications to ensure policy compliance.

14. Intellectual Property

All Platform content—including branding, text, design, and media—is owned by Winger and may not be copied, redistributed, or used without permission.

15. Privacy

Your use of Winger is subject to our separate Privacy Policy. By using the Platform, you consent to the collection and use of your data as described therein.

16. Disclaimers

Winger is provided "as is" without warranties. Winger disclaims all responsibility for:

• Aircraft safety, maintenance, or performance.
• User actions, qualifications, or behavior.
• Booking disputes, cancellations, or financial losses.
• Accuracy of listings or communications.

Users assume all risks related to aircraft rental and operation.

17. Limitation of Liability

To the maximum extent permitted by law, Winger is not liable for any:

• Personal injury, death, or property damage.
• Losses, damages, or claims arising from aircraft use.
• Disputes between Users.
• Financial, indirect, incidental, or consequential damages.

Your sole remedy for dissatisfaction with the Platform is to discontinue using it.

18. Indemnification

Users agree to indemnify and hold harmless Winger from claims, damages, liabilities, legal fees, and expenses resulting from:

• Use of the Platform.
• Aircraft rental or operation.
• Violations of these Terms or applicable laws.

19. Modification of Terms

Winger may modify these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

20. Termination

Winger may suspend or terminate accounts at its discretion. Users may discontinue use at any time.

21. Governing Law

These Terms are governed by the laws of the United Kingdom. Any disputes shall be resolved in the courts of the United Kingdom.
