Terms governing access to and use of FlyWinger Aviation Limited's website, booking platform, and future mobile applications.

FlyWinger Aviation Limited

Welcome to FlyWinger Aviation Limited ("FlyWinger", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, booking platform, and future mobile applications (collectively, the "Platform").

Please read these Terms carefully before using the Platform. By creating an account, making a booking, or listing an aircraft, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. About FlyWinger and the Platform

Marketplace intermediary

FlyWinger provides an online platform that connects independent aircraft owners ("Owners") with licensed pilots ("Pilots") seeking to rent aircraft for hour building or personal general aviation flights. FlyWinger is a marketplace intermediary and technology provider only.

What FlyWinger is not

FlyWinger does not own, operate, maintain, charter, or insure any aircraft listed on the Platform. We are not an air carrier, flight school, aviation training provider, or aviation authority. We do not act as agent for either Owners or Pilots except as payment facilitator for the purpose of processing transactions.

All rental agreements are made directly between the Owner and the Pilot. FlyWinger is not a party to the rental agreement except in its capacity as payment facilitator, as set out in Section 3.

Administrative verification only

FlyWinger may request that Pilots and Owners upload certain documents and may carry out checks to verify that documents have been uploaded and appear valid on their face. Such verification is administrative only. It does not constitute a representation, warranty, or certification by FlyWinger that any Pilot is competent, current, medically fit, legally entitled to operate any specific aircraft, or otherwise suitable to fly. Aircraft Owners remain solely responsible for determining whether to permit a rental and for carrying out their own checks before authorising any flight.

2. User accounts

Registration

To access booking features, you must register an account. You agree to:

  • Provide accurate, current, and complete information at registration and keep it up to date.
  • Keep your login credentials confidential and not share them with any third party.
  • Notify us immediately at support@flywinger.com if you suspect unauthorised access to your account.

You are responsible for all activity that occurs under your account.

Pilot prerequisites

Pilots must upload and maintain valid, in-date credentials. By requesting a booking you warrant that you hold, and will continue to hold throughout the rental period:

  • A valid pilot licence appropriate for the aircraft type and category.
  • A current, valid Medical Certificate, Class 1 or Class 2 as required.
  • Valid class, type, or differences ratings required for the specific aircraft.
  • Evidence of meeting applicable currency requirements.
  • Any additional endorsements required by the aircraft Owner or applicable regulations.

Owner prerequisites

Owners listing aircraft warrant that they have full legal authority to list the aircraft and that throughout any rental period the aircraft is:

  • Registered with the UK Civil Aviation Authority (CAA), EASA, or the relevant national aviation authority.
  • In possession of a current Certificate of Airworthiness or Permit to Fly and a valid Airworthiness Review Certificate.
  • Maintained in accordance with an approved maintenance programme by appropriately certified engineering personnel.
  • Covered by adequate aviation insurance as set out in Section 5.

3. Bookings, payments, and financial terms

Payment processing

All payments are processed via our integrated third-party payment processor, Stripe. FlyWinger does not store, view, or handle full payment card data. By making a payment you agree to Stripe's own terms and privacy policy in addition to these Terms.

How bookings work

When a Pilot submits a booking request, an authorisation hold is placed on the Pilot's payment method. No funds are captured until the Owner confirms the booking. If the Owner declines, the authorisation hold is released and no charge is made.

Platform service fee

FlyWinger charges a platform service fee for facilitating bookings. The applicable fee is calculated and displayed transparently to the Pilot before payment is confirmed. The service fee is charged to the Pilot in addition to the Owner's listed hourly or block rate.

Flight time calculation

Rental fees are calculated on the basis stated in the individual aircraft listing, such as Hobbs meter time, tachometer time, block time, or a pre-agreed hourly or block package. It is the Pilot's responsibility to confirm the basis of calculation with the Owner before flight.

Cancellations and refunds

  • FlyWinger service fee: Refundable only if the booking is cancelled within 24 hours of the Owner's booking confirmation, provided the booking was not requested within 7 days of the scheduled flight date. If the booking was requested within 7 days of the flight date, the service fee is non-refundable regardless of when cancellation occurs.
  • Payment processing fees: Non-refundable in all circumstances.
  • Aircraft rental fees: Subject to the refund policy of the individual Owner as stated in the aircraft listing. FlyWinger does not set or guarantee Owner refund terms.
  • Weather and technical cancellations: Where a flight is cancelled due to adverse weather or a certified technical defect in the aircraft, any refund of the rental fee is a matter between the Pilot and the Owner. FlyWinger may assist in resolving disputes at its discretion but is not obligated to do so.

4. Operational safety and flight responsibilities

Pilot-in-command authority and responsibility

Except where a flight instructor or safety pilot is on board and acting as Pilot-in-Command (PIC) in accordance with applicable regulations, the renting Pilot acts as sole PIC for the duration of the booking. The PIC is exclusively responsible for:

  • The safe conduct and operation of the flight.
  • Pre-flight planning, weather assessment, fuel management, and route selection.
  • Compliance with the Air Navigation Order, CAA regulations or relevant authority, and applicable NOTAMs, airspace restrictions, and ATC requirements.
  • Pre-flight inspection of the aircraft in accordance with applicable regulations and the aircraft's Pilot Operating Handbook or Flight Manual.

FlyWinger's role in operations

FlyWinger is a software platform and marketplace provider only. FlyWinger has no operational control over any aircraft or flight and is not responsible for flight planning, aircraft dispatch, or any operational decision made by the Pilot or Owner.

Pre-flight inspection

The Pilot is responsible for carrying out a thorough pre-flight inspection in accordance with applicable regulations and the aircraft's Pilot Operating Handbook or Flight Manual before each flight. Nothing in these Terms transfers the Owner's legal responsibilities regarding aircraft maintenance or continuing airworthiness to the Pilot or to FlyWinger. If the Pilot identifies any defect, damage, or logbook inconsistency during inspection, the Pilot must not fly the aircraft and must report the matter to the Owner and via the Platform immediately.

Incident and accident reporting

In the event of an incident, airspace infringement, or reportable accident, the acting PIC must:

  • Immediately notify the relevant authorities, such as AAIB, CAA, or equivalent.
  • Notify the Aircraft Owner as soon as practicable.
  • Report the event via the Platform.
  • Cooperate fully with all regulatory and safety investigations.

5. Insurance

Owner insurance requirements

Owners must, at all times while their aircraft is listed on the Platform and throughout any rental period, maintain:

  • Hull insurance covering the aircraft for third-party rental or self-fly hire use.
  • Third-party liability insurance at an adequate level for the aircraft type and operations.
  • Passenger liability insurance where passengers are carried.
  • Self-fly hire cover explicitly extending to Pilots who are not the Owner or a named pilot on the policy.

Owners must provide evidence of current insurance to FlyWinger and to the booking Pilot on request. FlyWinger reserves the right to remove any listing where adequate insurance cannot be evidenced.

Additional insured

Owners should use reasonable efforts to have FlyWinger Aviation Limited listed as an additional insured under their aviation third-party liability policy where this is available and practicable.

Insurance excess liability

In the event of damage to the aircraft, third-party property, or other assets during the rental period:

  • The Pilot may be responsible for paying the insurance excess specified in the Owner's listing, up to any cap stated therein, where damage results from the Pilot's acts or omissions during the rental period and not from a pre-existing defect or the Owner's failure to maintain the aircraft.
  • Where damage results from the Pilot's gross negligence, including flight outside applicable weather minimums, operation without valid ratings, or deliberate violation of the aircraft's Flight Manual limitations, the Pilot may be held personally liable for repair costs, loss of use, and other recoverable losses beyond the stated excess.

No FlyWinger insurance

FlyWinger does not provide aviation insurance, hull insurance, liability insurance, or passenger liability insurance to Owners or Pilots. It is the sole responsibility of Owners and Pilots to ensure they hold adequate insurance before any flight takes place.

6. Prohibited activities

Users agree not to use the Platform or any rented aircraft to:

  • Conduct illegal commercial flights, public transport operations, or air taxi services for valuable consideration in contravention of applicable aviation law.
  • Carry out aerobatic manoeuvres, formation flights, or flight testing unless explicitly authorised in writing by the Owner and covered by the aircraft's insurance policy.
  • Operate in prohibited, restricted, or danger areas, or land at airfields not approved by the Owner or the aircraft's insurance policy.
  • Sub-lease, lend, or transfer operational control of the aircraft to any person not registered on the Platform or not authorised by the Owner.
  • Provide false, misleading, or fraudulent information regarding identity, licensing, ratings, currency, or insurance.
  • Use the Platform for any unlawful purpose or in any manner that violates applicable aviation regulations.

7. Disputes between Owners and Pilots

FlyWinger is not a party to the aircraft rental agreement between an Owner and a Pilot except as payment facilitator. Disputes relating to aircraft condition, operational matters, flight conduct, damage, fuel, maintenance, delays, weather cancellations, or refunds of rental fees are matters between the Owner and the Pilot.

FlyWinger may, at its sole discretion, assist in resolving disputes between Owners and Pilots but is under no obligation to do so and does not guarantee any particular outcome.

8. Limitation of liability

What cannot be excluded

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the laws of England and Wales, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under the Consumer Rights Act 2015 or the Unfair Contract Terms Act 1977.

What is excluded to the maximum extent permitted by law

Subject to the paragraph above, to the maximum extent permitted by applicable law, FlyWinger Aviation Limited shall not be liable for any direct, indirect, incidental, special, or consequential loss or damage arising from your use of the Platform, including but not limited to:

  • The mechanical condition, airworthiness, fitness for purpose, or sudden unserviceability of any aircraft listed on the Platform.
  • Personal injury, property damage, or death resulting from pilot error, weather conditions, mechanical failure, or any other cause arising during a flight.
  • The cancellation of bookings by Owners or non-attendance by Pilots.
  • Loss of data, revenue, or profits arising from Platform downtime, errors, or interruptions.
  • The accuracy, completeness, or currency of any document, licence, rating, or credential uploaded by a User.

9. Indemnity

Each User agrees to indemnify, defend, and hold harmless FlyWinger Aviation Limited and its directors, officers, employees, and agents from and against any and all claims, losses, liabilities, costs, damages, and legal expenses, including reasonable solicitors' fees, arising from or relating to:

  • The operation of any aircraft booked or listed via the Platform.
  • Any breach of these Terms by the User.
  • Any breach of applicable aviation law or regulation by the User.
  • Any negligent, reckless, or unlawful act or omission by the User.
  • Any claim by a third party arising from the User's use of the Platform or operation of an aircraft.

10. Platform availability

FlyWinger does not warrant or guarantee that the Platform will be available at all times, free from errors, uninterrupted, or suitable for any particular purpose. We reserve the right to suspend or withdraw access to the Platform for maintenance, improvement, or any other reason with or without notice.

11. Force majeure

FlyWinger shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including adverse weather events, CAA or regulatory restrictions, strikes or industrial action, payment processor outages, cyberattacks, failures of third-party cloud or infrastructure services, acts of God, pandemic, or government action.

12. Data protection and privacy

FlyWinger processes personal data in accordance with our Privacy Policy, which forms part of these Terms and is available at https://flywinger.com/privacy. By using the Platform you confirm that you have read and understood our Privacy Policy.

13. Termination of accounts

FlyWinger reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or permanently terminate any user account where we reasonably suspect:

  • A material violation of CAA safety regulations or applicable aviation law.
  • Provision of fraudulent, false, or materially misleading identity documents, licences, ratings, or insurance information.
  • A material breach of these Terms.
  • Non-payment of sums due.
  • Conduct that poses a risk to the safety of persons or property.

Where termination occurs other than for cause, we will provide reasonable notice where practicable. Termination does not affect any accrued rights or obligations of either party.

14. Amendments to these Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or by prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of any change constitutes your acceptance of the updated Terms.

15. Governing law and jurisdiction

These Terms, their subject matter, and their formation are governed by the laws of England and Wales. You and FlyWinger Aviation Limited agree to submit to the exclusive jurisdiction of the courts of England and Wales in respect of any dispute arising under or in connection with these Terms, save that FlyWinger may seek injunctive relief in any jurisdiction where necessary to protect its rights.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.

17. Entire agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and FlyWinger Aviation Limited in relation to your use of the Platform and supersede all prior agreements, representations, and understandings.
